| 1.2.2. Efficiency | Test with a brake tester or, if one cannot be used for technical reasons, by a road test using a deceleration recording instrument to establish the braking ratio which relates (a) to the maximum authorised mass or, (b) in the case of semi-trailers, to the sum of the authorised axle loads, or (c) to reference values. Vehicles or a trailer with a maximum permissible mass exceeding 3,5 tonnes must be inspected following the standards given by ISO 21069 or equivalent methods. For vehicles not inspected following the standards given by ISO 21069 or equivalent methods, if the minimum figure of braking ratio is not achieved, at least meaningful brake testing must be performed. Meaningful brake testing is performed if brake efficiency is below the service, secondary or parking values prescribed in 1.2.2 or 1.3.2 or 1.4.2 but all the following conditions are met: — the braking system is in good condition with no obvious defects, — wheels of all axles lock because adhesion between the tyre and brake tester surface was exhausted during the brake test; if wheels on some axles do not lock, it must be safely concluded that the braking efficiency values prescribed in 1.2.2 or 1.3.2 or 1.4.2 would be achieved when the vehicle is loaded, — brake actuation level by the inspector must always be proportional to the current load of the axle. Information on system values may be retrieved using electronic vehicle interface. Road tests should be carried out under dry conditions on a flat, straight road. In cases where vehicles of R or T category are tested on the road, meaningful brake testing is performed if all the above conditions are met. In case of doubt, the braking efficiency shall be demonstrated in loaded or partially loaded condition. | Does not give at least the minimum figure as follows (1): 1. Vehicles registered for the first time after 1/1/2012: — Category M1: 58 % — Categories M2 and M3: 50 % — Category N1 50 % — Categories N2 and N3: 50 % — Categories O2, O3 and O4: — for semi-trailers: 45 % (2) — for draw-bar trailers: 50 % | X | ||

In practice, if this wording is maintained, there is a risk that vehicles with defective or unsatisfactory brakes will be type-approved. In view of the risk involved, we propose deleting this one entry from the table.

The state of health of batteries was not included in the COM proposal - by including this, owners and buyers can have better information about the functioning of the batteries in vehicles that use such technology for propulsion and for safety purposes.

| Too high resistance (over 100 m) | X |
The test with 100 Ohms is senseless. In ECE R100 100milliOhms is defined and this is the correct value measuring ground continuity or earth conductor. 100 Ohms is not a valid reference value. Inspection of this point should be mandatory, given that it is part of the R100 regulation.

This is not a safety-relevant item; it creates unnecessary failures and administrative burden (and is also impractical, as not every charging context requires a cable to be carried in the vehicle).

The need for an effective and reliable suspension test is nowadays even more evident with electronic-assisted braking systems and ADAS (Advanced driver-assistance systems) equipped vehicles already on the road, self-driving vehicles soon to come, and heavier EVs.
The suspension system is a vital element for the vehicle's braking ability and direction control. Nowadays, there are suspension testers on the market suitable for testing the suspension systems of vehicles in categories M1 and N1 during statutory periodical technical inspections, whose goal is to ensure road safety. Suspension tests for M1 and N1 category vehicles should be part of the roadworthiness test, as initially proposed by the European Commission.

The Commission shall adopt implementing acts specifying the analytical parameters to be verified, the minimum detectable thresholds, the recognition criteria for rapid-test devices and the requirements for accreditation of laboratories. | Fuel sample does not comply with the applicable Union or national fuel-quality standard, including cases of incorrect fuel type, adulteration, contamination, excessive sulphur, fatty-acid methyl ester or water content, insufficient lubricity, presence of foreign matter, or any other prohibited characteristic. | X |

As vehicle approval legislation—such as the GSR, Regulation (EU) 2019/2144, and Regulation (EU) 2018/858—does not require vehicles to be equipped with cornering lights, this feature cannot be mandated in periodic technical inspections. Accordingly, a malfunctioning cornering light cannot be deemed a defect. Inspection capacity should be directed toward legally required, safety-relevant systems.

With regard to points (f) and (h), the minor defects should be deleted as there is no point in including them: if a defect does not affect the safety of the vehicle, it should not be checked during a roadworthiness test. Another point is that it should be difficult for the inspector to differentiate between major and dangerous defects. Therefore, only major defects should be retained.

Since the vehicle approval regulations (e.g., GSR, Regulation (EU) 2019/2144, or Type Approval Regulation (EU) 2018/858) do not stipulate that vehicles must be equipped with a high beam assist system, this function cannot be required during periodic technical inspections of motor vehicles. If the system malfunctions, this cannot be considered a defect. Inspection resources should be used efficiently by focusing on mandatory safety-related aspects.

A ‘fully automated vehicle’ is one that can move without a driver whilst an ‘automated vehicle’ still requires a driver, at least in part, and hence the amendment makes the description more flexible to account for both elements.

| (i a) A device to connect to the electronic vehicle interface, such as an EOBD/OBM scan tool |
To ensure proper testing of modern cars during PTI, the OBD protocol should be updated to the latest version, such as EOBD/OBM. Modern vehicles rely heavily on electronic control systems for safety and emissions performance. Using EOBD/OBM in PTI aligns the inspection method with the technological reality of current vehicle design. EOBD and OBM provide direct diagnostic information on the status and performance of emission-relevant components and systems.EOBD and OBM are justified for use during PTI because they provide standardised, cost-effective, and objective access to in-use diagnostic and operational data that are essential for verifying the functionality of safety- and emission-relevant systems over the vehicle lifetime.

| (16) device to measure particle number emissions with sufficient accuracy; | (16) device to measure particle number emissions with sufficient accuracy, in accordance with Commission Recommendation (EU) 2023/688, as adopted on 20 March 2023. |
The original wording “sufficient accuracy” is not clear enough, for there is no detail on how something can be defined as “sufficient”. As the Commission has already produced a recommendation on the topic, which includes details on minimum accuracy requirements deemed reasonable by the industry, including such a reference would improve the final text and avoid uneven application across the EU.

To ensure correct and repeatable measurement quality, not only devices measuring gaseous emissions, but also devices measuring opacity, Particulate number, and noise should be calibrated at intervals of no more than 12 months between successive calibrations.
