Text proposed by the Commission	Amendment(ea) The following paragraph is added: 12a. Where goods listed in Annex I have been imported into an outermost region within the meaning of Article 349 TFEU under a temporary derogation from the obligations laid down in this Regulation, and are subsequently introduced into the customs territory of the Union outside the outermost regions without having undergone, in an outermost region, processing which is substantial within the meaning of Article 60(2) of Regulation (EU) No 952/2013, the obligations laid down in this Regulation shall become applicable to those goods.
Text proposed by the Commission	AmendmentAny legal person intending to introduce such goods into the customs territory of the Union outside the outermost regions shall, submit a declaration to that effect to the competent authority of the Member State to which the outermost region concerned belongs, and shall keep records enabling the goods concerned to be traced. That legal person shall be treated as the importer of those goods for the purposes of this Regulation.

Justification

The outermost regions form part of the customs territory of the Union. Goods released for free circulation there are in free circulation throughout the Union, and their shipment to the mainland gives rise to no customs declaration, so such movements are currently undetectable. This amendment sets out what happens once the goods leave those regions, without affecting the conditions, duration or renewal of any derogation. The obligations return only where the goods leave essentially unaltered.

Justification

Under the current proposal, whilst generators for wind turbines are included within the scope if the CBAM, gearboxes are not. This would create an artificial advantage for technologies using gear drives and would not provide a technology-neutral framework.
