| 21a. Firmly opposes any proposal to exclude Ukrainian nationals of military age from the scope of the Temporary Protection Directive1a or to condition their continued protection status on compliance with Ukrainian military mobilisation requirements; recalls that the Temporary Protection Directive is a humanitarian instrument designed to provide immediate protection to persons fleeing armed conflict, and that its application cannot be made conditional on the military or political choices of the country of origin; stresses that the right to seek protection from war as well as the right to conscientious objection are fundamental rights that apply equally to all persons regardless of age or gender, and that the EU Member States have an obligation under international and EU law to ensure that no person is forcibly returned to a country where they face a real risk of being sent to the front line of an active armed conflict; calls on the Commission to issue clear guidance to Member States reaffirming the full and unconditional applicability of the Temporary Protection Directive to all Ukrainian nationals, including persons of military age, and to ensure that no bilateral arrangements between Member States and Ukraine result in the de facto or de jure deprivation of protection status; 1a Council Directive 2001/55/EC of 20 July 2001 on minimum standards for giving temporary protection in the event of a mass influx of displaced persons and on measures promoting a balance of efforts between Member States in receiving such persons and bearing the consequences thereof (OJ L 212, 7.8.2001, p. 12, ELI: http://data.europa.eu/eli/dir/2001/55/oj). |
