Union certification framework for carbon removals

European Parliament legislative resolution of 10 April 2024 on the proposal for a regulation of the European Parliament and of the Council establishing a Union certification framework for carbon removals (COM(2022)0672 – C9-0399/2022 – 2022/0394(COD))

The European Parliament,

–having regard to the Commission proposal to Parliament and the Council (COM(2022)0672),

–having regard to Article 294(2) and Article 192(1) of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C9-0399/2022),

–having regard to Article 294(3) of the Treaty on the Functioning of the European Union,

–having regard to the opinion of the European Economic and Social Committee of 22 March 2023,

–having regard to the opinion of the Committee of the Regions of 8 February 2023,

–having regard to the provisional agreement approved by the committee responsible under Rule 74(4) of its Rules of Procedure and the undertaking given by the Council representative by letter of 8 March 2024 to approve Parliament’s position, in accordance with Article 294(4) of the Treaty on the Functioning of the European Union,

–having regard to Rule 59 of its Rules of Procedure,

–having regard to the opinion of the Committee on Agriculture and Rural Development,

–having regard to the letter from the Committee on Industry, Research and Energy,

–having regard to the report of the Committee on the Environment, Public Health and Food Safety (A9-0329/2023),

1.Adopts its position at first reading hereinafter set out;

2.Takes note of the statement by the Commission annexed to this resolution;

3.Calls on the Commission to refer the matter to Parliament again if it replaces, substantially amends or intends to substantially amend its proposal;

4.Instructs its President to forward its position to the Council, the Commission and the national parliaments.

Position of the European Parliament adopted at first reading on 10 April 2024 with a view to the adoption of Regulation (EU) 2024/… of the European Parliament and of the Council establishing a Union certification framework for permanent carbon removals, carbon farming and carbon storage in products

(As an agreement was reached between Parliament and Council, Parliament's position corresponds to the final legislative act, Regulation (EU) 2024/3012.)

ANNEX TO THE LEGISLATIVE RESOLUTION

Commission statement on the occasion of the adoption of Regulation (EU) 2024/3012 of the European Parliament and of the Council establishing a Union certification framework for permanent carbon removals, carbon farming and carbon storage in products

The Commission intends to adopt the first delegated act, within one year after the entry into force of the Regulation, and to publish on its website, within six months after the entry into force of the Regulation, a forward planning document on the development of certification methodologies, which will be updated every year.

In addition, the Commission intends to organise appropriate opportunities to comment on the delegated acts, including through public feedback.

The Commission will comply with its commitments related to ensuring the Parliament’s and Council’s involvement in the process of preparation of delegated acts, including through systematic access for experts from the Parliament and Council to the meetings of the Commission expert groups as laid down in point 28 and the Annex to the Inter-institutional Agreement on Better Lawmaking of 2016.
