A mere change in the title of the objective without insertion of additional indicators is considered to be a completely inadequate amendment related to this specific objective. The recital introducing the rationale for the targeted review talks about climate resilience, threat of water scarcity, and risk-based management and increased preparedness. Revised UWWTD also raises ambition, including not only secondary treatment, but also tertiary and quaternary treatment in the context of the sustainable water management. Additional indicators pertinent for the overarching objective of water resilience are thus inserted.

The proposed amendment aims to align the Cohesion Policy funding instruments with the strategic priorities of the European Union’s energy transition, specifically the deployment of long-duration electricity storage infrastructure, such as pumped-storage hydropower (PSH).The proposed change is therefore: Legally sound, building on existing eligibility clauses and definitions; Politically coherent, aligned with new EU funding and labelling tools; Practically necessary, to unlock funding for ready-to-implement strategic PSH projects during the reprogramming window.

There are already today possibilities for Member States to amend programmes or transfer amounts according to Article 24 and 26 of the Common Provisions Regulation. Since the mid-term review is derogating from the Common Provisions Regulation, other issues of fundamental importance must be raised in this context. It cannot be foreseen by legislator or justifiable for Member States to be able to amend programmes or transfer amounts that are withheld based on enabling conditions under Article 15 of the Common Provisions Regulation or based on the Rule of Law Conditionality Regulation.
