| (1a) The conservation of marine biological resources under the common fisheries policy is the only aspect of fisheries policy constituting an exclusive competence of the Union pursuant to Article 3(1), point (d), of the Treaty on the Functioning of the European Union. All other aspects of fisheries, maritime and aquaculture policy, including the programming, allocation, management and implementation of Union support, fall within shared competence pursuant to Article 4(2), point (d), TFEU and are therefore subject to the principle of subsidiarity. The integration of that support into the National and Regional Partnership Fund and its single rulebook shall not result in a centralisation of decision-making at Union level or in a diminished role for the Member States and their regional and local authorities. Due account should be taken of the reasoned opinions submitted under Protocol No 2 by the national parliaments which considered that the proposal does not comply with the principle of subsidiarity. |

Union support under this Regulation should therefore contribute to reducing animal suffering in fisheries and aquaculture, improving the welfare of farmed aquatic animals, and preventing avoidable injury and mortality of non-target species. |

| (3) The National and Regional Partnership Fund should contribute to achieving the environmental, economic, social and employment objectives of the Common Fisheries Policy (CFP), as set out in Article 2 of Regulation (EU) No 1380/2013 of the European Parliament and of the Council3 . With the average age in many fishing communities exceeding 50, generational renewal and diversification of activities remain significant challenges. In particular, the creation and development of new economic activities in the fisheries sector by young fishers is financially challenging and should therefore be taken into account in the allocation and targeting of funds under this Regulation. Such development is essential for the competitiveness of the fisheries sector in the Union. Therefore, the EMFAF should support, under shared management, the development and implementation of a Union fisheries control system as set out in Council Regulation (EC) No 1224/2009. | 1.Member States may grant crisis payments to fishers and aquaculture producers who are affected by exceptional emergency situations such as natural disasters, adverse climatic events, catastrophes or other crisis situations.Such payments shall be intended to ensure the continuity of fisheries or aquaculture or related activities and shall be subject to the conditions laid down in this Article and specified in more detail by the Member States. | |

(a) The emergency measures explicitly include income support for sectoral workers in case of a temporary cessation of activities that is either beyond the control of the enterprise and the fishers on board vessels or the result of exceptional crisis situations, ensuring that periods of forced inactivity are covered and safeguarding jobs. | |
| 3.Operators shall be considered to depend on the fishery and aquaculture products when the products or activities affected by the situation have accounted for at least 30% of their average annual commercial activities over the preceding three-year period, or of a three-year average based on the preceding five-year period, excluding the highest and lowest values. | |

| Definitions | |
| For the purposes of this Regulation, the following definitions apply: | |
| (1) 'small-scale coastal fishing'means fishing activities carried out by: | |
| (a) fishing vessels meeting at least three of the following criteria: | |
| (i) their overall length does not exceed 12 metres; | |
| (ii) they operate exclusively in the territorial waters of the flag State; | |
| (iii) their trips last less than 24 hours, from the time of departure from port to the time of return to port; | |
| (iv) their crew consists of no more than four persons; | |
| (v) they use selective fishing gear with low environmental impact; | |
| (b) fishers on foot, including shellfish gatherers; | |
| (2) 'fisher'means any natural person engaging in commercial fishing activities, as recognised by the Member State concerned including fishers on foot, such as shellfish gatherers; | |
| (3) ’fishing’ meansany natural person engaging in commercial fishing activities, as recognised by the Member State; | |
| (4) ‘sustainable blue economy’means all sectoral and cross-sectoral economic activities throughout the internal market relating to ocean, seas, coasts and inland waters, covering the Union’s insular and outermost regions and landlocked countries, including emerging sectors and non-market goods and services, which ensure environmental, social and economic sustainability in the long term and which are consistent with the SDGs, and in particular SDG 14, and with Union environmental legislation; | |
| (5) 'maritime policy'means Union policy that aims to foster integrated and coherent decision making to maximise the sustainable development, economic growth and social cohesion of the Union, particularly of the coastal and insular areas and of the outermost regions, and of the sustainable blue economy sectors, through coherent maritime-related policies and relevant international cooperation; | |
| (6) ‘maritime security and surveillance’means activities carried out in order to understand, prevent wherever applicable and manage in a comprehensive way all the events and actions related to the maritime domain which would impact the areas of maritime safety and security, law enforcement, defence, border control, protection of the marine environment, fisheries control, trade and economic interest of the Union; | |
| (7) ‘European marine observation and data network’ or ‘EMODnet’means a partnership assembling marine data and metadata in order to make those fragmented resources more available and usable by public and private users by offering quality-assured, interoperable and harmonised marine data; | |
| (8) ‘maritime spatial planning’ means a process by which the relevant Member State’s authorities analyse and organise human activities in marine areas to achieve ecological, economic and social objectives; | |
| (9) ‘ocean observation’means the foundation of all marine knowledge.It forms the basis of understanding of marine ecosystems and factors that influence them.It provides critical data for weather forecasting, climate change mitigation and adaptation strategies, extreme events monitoring, civil security – sea condition, floods-, maritime shipping, offshore energy, fisheries and aquaculture and increasingly security and defence.It creates the foundation for evidence-based decision-making and it provides crucial information on how human activities influence ocean health and what services the ocean provides to societies. | |
| (10) 'extensive aquaculture' means a system for rearing aquatic organisms characterised by low stocking density and the minimal use or absence of artificial feeds, which predominantly employs the natural ecosystem resources – including phytoplankton, zooplankton and nutrients present in the environment – to foster the growth of the organisms being farmed; this system includes, among other things, open-water shellfish farming, traditional lagoon farming, lagoon fish farming, and other forms of aquaculture integrated into the natural ecosystem, conducted in a manner that preserves or improves the ecological status of the aquatic environment and contributes to the provision of ecosystem services, including carbon sequestration, carbon farming, and the maintenance of biodiversity. |

| 3a. Through their NRP Plan, Member States shall: | |
| (a) use 50% of the Union financial support allocated to the objectives set out in Article 1 of this Regulation for support for sustainable fishing practices and to small-scale coastal fishers, including but not limited to: | |
| i) sufficient technical assistance to support simplified procedures for granting and for accessing aid to small-scale coastal fishers at local, national and European level; | |
| ii) aid schemes to ensure and support greater representation and representativeness of small-scale coastal fishers at local, national and European level; | |
| iii) aid schemes to support the transition away from towed gears as defined by Article 2 (1) of Council Regulation (EC) No 1967/2006, and the use of selective gear to minimise bycatch by adapting the technical specifications of the vessel and associated training of fishers with a specific focus on ecological impacts; | |
| iv) support for training of fishers towards new sustainable employment opportunities outside fishing activities; | |
| v) aid schemes to encourage consumers to favour the purchase of seafood products from EU low impact small-scale coastal fishers, including through advertising campaigns, initiatives to better inform consumers of the source and ecological impacts of seafood products, specific labelling of products sourced from EU small-scale coastal fishers, or other initiatives; | |
| vi) aid schemes exclusively for small-scale coastal fishers to support innovative business models, including direct-to-consumers schemes, fairtrade schemes, local value chains, short supply chains, and markets for local or underused species; | |
| vii) aid schemes for fish auction halls to compensate for temporarily lower catch volumes resulting from the adaptation of the fishing capacity to available fishing opportunities or resulting from the transition of the fishing fleet from towed gears as defined by Article 2 (1) of Council Regulation (EC) No 1967/2006; | |
| viii) support for the decarbonisation of fishing vessel engines, | |
| b) use 50% of the Union financial support allocated to the objectives set out in Article 1 of this Regulation for the protection and restoration of marine resources, ecosystems and biodiversity based on the best available scientific advice and in particular providing long-term benefits for the marine environment, including but not limited to: | |
| (i) support to the protection and restoration of aquatic biodiversity and ecosystems and the associated training of fishers; | |
| (ii) support to the management, control and enforcement of effective spatial management measures such as Natura 2000 zones, measures established pursuant to Article 13 (4) of Directive 2008/56/CE, measures established pursuant to Article 8 and 11 of Regulation (EU) 1380/2013, measures established under Regulation (EU) 2024/1991, or similar measures adopted at national level; | |
| (iii) support to small-scale coastal and recreational fishers engaging in the management, protection and restoration of marine and coastal areas; | |
| (iv) support to owners or operators of Union fishing vessels not using towed gears as defined by Article 2 (1) of Council Regulation (EC) No 1967/2006 for measures improving the selectivity of fishing gears, minimising bycatch and their impacts on the marine environment and ecosystems; | |
| (v) support for the development, testing, and deployment of measures aimed at minimising the negative impacts on fishing marine ecosystems, including measures aiming to reduce and eliminate bycatch of sensitive species for fishing vessels; | |
| (vi) support to operators for the collection of lost fishing gears and marine litter during regular fishing operations; | |
| (vii) support to the collection, management and use of data to foster efficient fisheries monitoring, control and enforcement, including fighting against illegal, unreported and unregulated fishing; | |
| (viii) support for measures to improve data collection and monitoring of sensitive species, including the installation of Remote Electronic Monitoring (REM) systems to monitor bycatch. |

| 3a. Member States shall establish and implement a mandatory compensation scheme dedicated to the progressive permanent cessation of all EU fishing vessels with a length overall greater than 33 meters. | |
| By 1 January 2035, the schemes for mandatory permanent cessation shall be completed, and all EU fishing vessels of an length overall greater than 33 meters shall be scrapped, decommissioned or retrofitted for activities other than commercial fishing. This support shall be calculated on the basis of the surface used for extensive production, which shall be measured in hectares in line with the internationally recognised scientific methodologies used to quantify the ecosystem services provided by extensive aquaculture, including blue carbon sequestration. Member States may, in their partnership plans, provide for specific per-hectare payment measures for aquaculture sector operators who document and maintain their facilities' temporary or permanent storage functions. |

| 1. Member States shall as part of the controls referred to in Article 58 [Responsibilities of Member States] verify the compliance of beneficiaries with the requirements of of this Regulation. | |
| a. Where the area eligible for the support referred to in the first subparagraph, as declared in the geo-spatial application referred to in Article 70 [IACS], does not exceed 10 hectares, the beneficiaries shall be exempted from controls and penalties under this Article. | |

Where a beneficiary has been selected for an on-the-spot check on an aid application or on a payment claim, Member States shall, to the extent possible and taking account of the associated risks, not select that beneficiary for a subsequent check and control sample for that year, except when the circumstances require more than one on-the-spot check in order to ensure the effective protection of the financial interests of the Union. This provision shall not reduce the level of checks. | |
| 2. Member States shall make use of their control and enforcement systems in the areas of climate and environment, public health, plant health and animal welfare, social and employment legislation, applicable labour standards, fisheries and aquaculture to ensure that beneficiaries of the support comply with the requirements set out in the first paragraph. | |

The managing authority or paying agency shall be notified where relevant at least once a year of cases of non-compliance where enforceable decisions in that respect have been made under the applicable control and enforcement systems referred to in paragraph 2. | 1. Member States may provide crisis payments to fisheries and aquaculture operators that are affected by natural disasters, adverse climatic events or catastrophic events. Those payments shall aim at ensuring continuity of the activity of those operators and shall be subject to the conditions set out in this Article and as further specified by the Member States. | |

Support under this Article shall be subject to the formal recognition by the competent authority of the Member State that a natural disaster, adverse climatic event or catastrophic event, as defined by the Member State, has occurred and that these events, have directly caused a damage resulting in the reduction of at least 30 % of the average annual production of the operator in the preceding three-year period or a three-year average based on the preceding five-year period, excluding the highest and the lowest entry. | |
| 3. The losses shall be calculated either at the level of fishing vessel or aquaculture operational site, at the level of the activity in the sector concerned or in relation to the specific area concerned. | |
| 4. Member States shall establish the applicable support rates for compensating the loss of production. Those rates shall be higher for operators who also implement interventions, or other preventive actions at operational unit level, to reduce the level of production and income risks for which support is granted. Indexes may be used for calculating the loss of production. | |

| Conditionality of reforms and scope of sectoral actions | |
| The requirements and recommendations specific to each sectoral policy shall apply only to the measures included in the chapter corresponding to that policy. Under no circumstances may they be extended to measures in other areas. Union funding under shared management may be made conditional only upon the fulfilment of steps and objectives linked to specific reforms at national level, on condition that it is demonstrated that such reforms are proportionate, well-calibrated, have a direct and demonstrable link to the objectives of the relevant Union policies, and are established at the appropriate level of competence. It should also be ensured that eligibility decisions concerning fisheries and aquaculture operators, in particular micro and small enterprises as defined in Commission Recommendation 2003/361/EC, are communicated within 60 working days following the submission of a complete application. | |
| Regional and local authorities, as well as other beneficiaries, shall not be penalised, nor shall their funding be suspended or reduced, nor shall they be held liable for the failure to implement reforms that fall exclusively within the national level and are outside their sphere of competence or responsibility. National reforms may only impose conditions on sub-national investments where such reforms have a direct local impact that contributes to the objectives of cohesion policy or generates clear cross-border benefits for the Union as a whole. | |
| To determine the direct local impact of these reforms, regional and local authorities shall assess whether the reforms have such an impact. | 1. An application for support submitted by an applicant shall be inadmissible for at least a specified period of time, if: | |
| (a)it has been determined by the competent authority that the applicant concerned (i) has committed serious infringements under Article 90 of Regulation (EC) No 1224/2009; | |
| (i) has committed serious infringements under Article 90 of Regulation (EC) No 1224/2009; | |
| (ii) has been involved in the operation, management or ownership of a vessel flying the flag of countries identified as non-cooperating third countries as set out in Article 33 of Regulation (EC) No 1005/2008; or | |
| (iii) has committed any of the environmental offences set out in Articles 3 and 4 of Directive 2008/99/EC of the European Parliament and of the Council13a, where the application for support is submitted for the aquaculture specific interventions; or | |
| 2. For the purposes of the verification whether an applicant has committed a serious infringement referred to in paragraph 1, point (a)(i), of this Article, a Member State concerned shall provide, on request from another Member State, the information contained in its national register of infringements referred to in Article 93 of Regulation (EC) No 1224/2009. | |
| 3.Where a beneficiary has committed one of the actions referred to in paragraph 1, in the period between submitting the application for the Union support and three years after the final payment, the Union support paid to the beneficiary and related to that application shall be recovered. | |
| 4. The Commission is empowered to adopt delegated acts in accordance with Article [__] concerning: | |
| (a) the identification of the threshold triggering, and the starting and ending dates and period of time of, the inadmissibility referred to in paragraph 1 of this Article, which shall be proportionate to the nature, gravity, duration and repetition of the serious infringments or offences by the beneficiary concerned and the importance of support to the economic activity of that beneficiary; | |

| 1. Member States shall support, under their NRP Plan, actions contributing to generational renewal in the fisheries sector. Support under the EMFAF may include, inter alia, actions aimed at: | |

| (i) support for the first acquisition of a vessel or of shares in a vessel, in accordance with Article 4 (3a); | |
| (ii) facilitation of access to licenses, quotas, or fishing opportunities for young fishers; | |

| (iv) support for the transfer of fishing businesses from retiring fishers to young fishers. | |

| (c) Improving working and living conditions, including: | |
| (i) safety improvements and modernisation of fishing vessels; | |
| (ii) investments in infrastructure for fishing ports, auction halls, landing sites and shelters; | |
| (iii) reductions of, or support measures to offset, social security contribution costs; or | |
| (iv) measures facilitating work-life balance. | |
| (d) Improving training and skills, including: | |
| (i) training programmes in areas such as navigation technology, sustainability, low impact fisheries, and business skills; | |
| (ii) apprenticeships and mentoring schemes pairing young fishers with experienced fishers; or | |
| (iii) communication and awareness-raising actions aimed at improving the attractiveness and image of the profession. | |
| 2. Member States shall ensure that Union support provided for actions aimed at facilitating generational renewal integrates a gender perspective and that, in the design and implementation of such actions, particular attention is paid to the role of women across the fisheries sector, as well as to their specific needs and challenges. |

Aid granted under this Article shall be subject to formal recognition by the competent authority of a Member State of the occurrence of an exceptional emergency situation, such as a natural disaster, an adverse climatic event, a catastrophe or other crisis situation, as defined by that Member State, and that the occurrence of that situation has caused a significant disruption to the fishery or aquaculture activity, the access to, supply of and demand for fishery and aquaculture products that the related operators referred to in paragraph 1 depend on, or a significant increase in their operating expenditure resulting from the occurrence of the situation. In particular, the situations referred to in the first subparagraph shall include the following: | |
| (a) temporary cessation of activities pursuant to measures referred to in Article 7(1), points (a), (b), (c), (i) and (j) of Regulation (EU) No 1380/2013, or equivalent applicable conservation measures adopted by regional fisheries management organisations if they apply to the Union; | |
| (b) temporary cessation of activities pursuant to Articles 12 and 13 of Regulation (EU) No 1380/2013; | |
| (c) temporary cessation of activities as a result of the non-compliance of a third country or territory with its international obligations or of the interruption of the application of an international agreement; | |
| and (d) temporary cessation of activities as a result of invasive species. | |
| 3. Fishers, aquaculture producers and related operators referred to in paragraph 1 shall be considered to depend on the fishery and aquaculture products when the products or activities affected by the situation have accounted for at least 30 % of their average annual commercial activities over the preceding three-year period, or of a three-year average based on the preceding five-year period, excluding the highest and lowest values. | |
| (3a) The first processors of fishery products shall be considered dependent on the fishery and aquaculture products where at least 20 % of their purchases are made through fish auctions whose activity depended on fishers or aquaculture producers affected by the temporary cessation, accounting for at least 5 % of the auction production over a three-year average based on the preceding five years, excluding the highest and lowest values. | |
