1. The Member States shall take all the necessary measures to ensure the smooth functioning of the actions supported under this section and may contribute with their technical competence, know-how and assistance, in particular in the field of safety, security, and frequency allocation. This contribution shall include, but not be limited to, making available to the Union data, information, services and infrastructure in their possession or located on their territory, that are necessary to the good functioning of the actions. The Member States shall be responsible, at local level, for the accreditation of the security of sites that are located within their territory and form part of the security accreditation area for the components, notably Member States participating in the SST Partnership shall perform security accreditation on the basis of the general security requirements referred to in Article 77.1. The Member States shall take all the necessary measures to ensure the smooth functioning of the actions supported under this section and shall contribute, including through their national space agencies or, where a Member State does not have a national space agency, through the competent national body designated by that Member State with their technical competence, know-how and assistance, in particular in the field of safety, security, and frequency allocation. This contribution shall include, but not be limited to, making available to the Union data, information, services and infrastructure in their possession or located on their territory, that are necessary to the good functioning of the actions. Member States shall make the widest possible use of the data, information, services and capabilities provided by the components referred to in this Section, in particular where they can support the implementation of Union and national policies, public services, security, resilience and strategic autonomy. The Member States shall be responsible, at local level, for the accreditation of the security of sites that are located within their territory and form part of the security accreditation area for the components, notably Member States participating in the SST Partnership shall perform security accreditation on the basis of the general security requirements referred to in Article 77. Member States shall ensure that their national space programmes and capabilities are designed and operated in a manner interoperable with the components referred to in this Section.

Justification

Maximising Member State use of Union space services is essential to consolidate aggregate demand, strengthen the European industrial base and anchor Union space capabilities within the broader European public-policy ecosystem. Interoperability between national space programmes and Union components is necessary to avoid duplication and misuse of public resources, prevent fragmentation of the European space ecosystem and reinforce the Union’s strategic autonomy.

Where necessary to further define and specify the governance, security and provision of services under this chapter, the Commission may, by means of implementing acts, complement the catalogue of services provided and shall determine the technical and operational requirements needed for the implementation of and evolution of the components under this chapter and of the services they provide after having consulted users and other stakeholders. When determining those technical and operational requirements, the Commission shall avoid reducing the general security level and shall meet backwards compatibility requirements. Those implementing acts shall be adopted in accordance with Article 83, paragraph 2.4. Where necessary to further define and specify the governance, security and provision of services under this chapter, the Commission may, by means of implementing acts, complement the catalogue of services provided and shall determine the technical and operational requirements needed for the implementation of and evolution of the components under this chapter and of the services they provide after having consulted users and other stakeholders. c. Mercator Ocean International (MOI), in particular for marine environment monitoring services, ocean data processing, forecasting, modelling and dissemination of marine data, products and information.
d. the European Environment Agency (EEA), in particular for environmental monitoring, reporting, compliance assurance, land monitoring, biodiversity, climate adaptation and the uptake of Copernicus data, products and information by public authorities;
e. the European Border and Coast Guard Agency (Frontex), in particular for user requirements, operational uptake and support to services related to border surveillance and situational awareness at the external borders of the Union;`

European Space Agencies Forum
1. A European Space Agencies Forum is hereby established.
2. The Forum shall be composed of the Agency, the European Space Agency, and the national space agencies of the Member States or, where a Member State does not have a national space agency, the competent national body designated by that Member State. Other entrusted entities involved in the implementation of the components referred to in this Section may participate where relevant.
3. National space agencies or competent national bodies of EFTA countries may participate in the Forum where an agreement concluded between the Union and the country concerned provides for such participation in the relevant components or activities.
4. The European Parliament and national parliaments shall be entitled to appoint representatives to participate in the Forum as observers.
5. The Forum shall contribute to the identification, aggregation and exchange of user, operational, technical and industrial needs relevant for the implementation and evolution of the components referred to in this Section. It shall facilitate coordination between the entities involved in the implementation of those components and support the monitoring of their implementation, including as regards service continuity, performance, risks, capability gaps and future needs.
6. The Forum shall identify ways to strengthen synergies, pool resources, avoid duplication and improve cooperation between the entities mentioned in the paragraph 2, including possible closer cooperation, consolidation or rationalisation of existing structures.
7. The Forum may provide recommendations to the Commission. Those recommendations shall be without prejudice to the responsibilities of the Commission, the Member States, the Agency, the European Space Agency and other entrusted entities under this Regulation, and shall not affect the committee procedure referred to in Article 83.
8. The Commission shall ensure the secretariat of the Forum. The Forum shall meet at least twice a year and whenever necessary at the request of the Commission.

This addition addresses one of the main weaknesses of European space governance: fragmentation between Union, ESA and national actors. By creating a European Space Agencies Forum, it would provide a permanent structure to identify common needs, monitor implementation, anticipate capability gaps and improve coordination between agencies. It would strengthen the coherence and efficiency of the Union Space Programme, while avoiding duplication and preserving the responsibilities of the Commission, Member States and entrusted agencies.

The Commission proposal does not specify the key performance indicators by which the implementation of the ECF will be monitored, beyond the general reporting obligations under the Financial Regulation. The amendment establishes a minimum set of indicators that enable the European Parliament, the Council and Member States to assess the geographical distribution of awards, the participation of SMEs, the deployment of the budgetary guarantee, and the use of the experimental procedures established under Article 20. Regulation (EU) 2021/783 is amended as follows:
(1) Article 1 is replaced by the following:
'Article 1
Subject matter
This Regulation establishes a Programme for the Environment and Climate Action (LIFE) (the 'LIFE Programme') for the period from 1 January 2028 to 31 December 2034.
This Regulation also lays down the objectives of the LIFE Programme, its budget, the forms of Union funding, its direct management and rules for providing such funding.’

Justification

The amendment aims to re-establish a stand alone LIFE programme, which will be directly managed with clear and transparent funding rules and implemented across all EU Member States.
