| 6.2a. Means of transport by road used for transporting terrestrial animals, except for dogs and cats, on long journeys shall be fitted with a temperature-monitoring system and a means of recording such data. Sensors shall be located in the lorry compartment. Temperature recordings obtained in such manner shall be dated and made available to the competent authority upon request. 6.4. The recordings specified in paragraph 6.3. shall be stored in the information system referred to in Article 24(1). The stipulations of Article 24(2), (3) and (5) to (8) apply accordingly. |
It is necessary to fit means of transport by road with temperature monitoring systems when transporting terrestrial animals, except for dogs and cats, on long journeys because the proposed amendment to Article 31(2) provides that it is the temperature inside that counts on long journeys. In addition, live tracking should be enabled in accordance with the rules on positioning systems referred to in Article 24.
| Text proposed by the Commission | Amendment |
|---|---|
| 6.2a. Means of transport by road should be fitted with a temperature monitoring system as well as with a means of recording such data. Sensors must be located in the parts of the lorry which, depending on its design characteristics, are most likely to experience the worst climatic conditions. Temperature recordings obtained in such manner should be dated and made available to the competent authority upon request. |

| 6.2a. Ventilation systems on means of transport by road shall be designed, constructed and maintained in such a way that, at any time during the journey, whether the means of transport is stationary or moving, they are capable of maintaining a range of temperatures from 5 °C to 30 °C within the means of transport, for all animals, with a +/- 5 °C measurement tolerance, depending on the outside temperature. |
| Text proposed by the Commission | Amendment |
|---|---|
| 6.2a. Road vehicles must be equipped with a temperature monitoring system. The sensors must be placed in the parts of the truck which, according to its design characteristics, are most likely to experience the highest temperatures under loading and unloading conditions. |
| Text proposed by the Commission | Amendment |
|---|---|
| 6.2a. Means of transport by road should be fitted with a warning system making it possible to alert the driver when the temperature inside the vehicle is too high or too low. |
It is disproportionate to rely on exterior temperature forecasts to impose the obligations of this article without taking into account the temperature, air flow, species transported or other indicators inside the means of transport. Therefore, in addition to deleting Article 31 of the proposal, the rules on ventilation and temperature in means of transport in Regulation 1/2005 should be reintroduced.
| Text proposed by the Commission | Amendment |
|---|---|
| 6.2b. The ventilation system must be capable of ensuring even distribution throughout with a minimum airflow of nominal capacity of 60 m3/h/KN of payload. It must be capable of operating for at least 4 hours, independently of the vehicle engine. |

|---|---|
| 6.2e. The Commission shall draw up a report before 31 July 2027 on the basis of an opinion of the European Food Safety Authority, accompanied by appropriate draft measures with a view to establishing maximum and minimum temperatures for animal transportation, taking into account the prevailing temperatures within certain regions of the Community having particular climatic conditions. On the basis of this report, Member States may define divergent national requirements for animal transportation on their own territory that take account of regional temperatures. |
| Text proposed by the Commission | Amendment |
|---|---|
| 6a. Means of transport by road must have a temperature monitoring system. Sensors must be located in those parts of the lorry which, depending on its design characteristics, are most likely to monitor the temperatures in loaded and unloaded conditions in the most accurate way. |

The Commission's proposed definition of the height of the transport space is unusable in practice. This amendment proposes to delete it. It is proposed to set the dimensions of the space for the transport of animals as it is today - the height, width and depth of the space for each animal and the density of placement. As is the case in the current version of Council Regulation (EC) No 1/2005.

In order to restore Annex I - Chapter VII - points A to D of Regulation 1/2005. When correctly applied, and when trucks are properly acclimatised, the current space allowance rules are well-suited to ensuring the protection and welfare of animals during transport.
The Commission’s proposed changes would put more trucks on the road, increasing emissions, congestion, safety risks and transport costs - potentially passed to consumers - while also threatening transport companies’ viability and raising the risk of animal injuries.

| 4a. 5. For cats and dogs, the following provisions must be complied with: | |
| a. A dog or cat transported alone in a container must have enough space to stand up fully and hold its head in a natural position. It must be able to sit upright comfortably, turn around and lie down normally, and rest in a natural position | |
| b. In the case of dogs being transported with other dogs, there must be adequate space for all dogs to carry out all these behaviours without touching other dogs, and allow them to stand, sit, turn and lie comfortably. If dogs and cats are being transported together in a single vehicle, containers must be arranged in a manner where dogs do not walk in front of cats when being loaded or unloaded onto the vehicle (including during rest stops). | |
| c. In the case of cats transported with other cats, there must be enough space allowed for them to stand, sit, turn and lie comfortably; | |
| d. Puppies and kittens under 8 weeks must share the container with their mother ; | |
| e. Puppies and kittens under 14 weeks should be transported together if transported without their mother; | |
| f. Suitable, non-slip bedding must be supplied as appropriate. Any bedding material used must be nontoxic, absorbent, non-allergenic and padded so as not to cause injury. Puppies and kittens of transportable age must be provided with adequate quantities of a bedding material appropriate to the species to ensure their thermal comfort and adequately absorb urine and faeces. Materials such as newspaper, shredded paper, sawdust or straw must not be used, and; | |
| g. The cat container must contain a litter box with enough unused litter to absorb and cover excrement. |

The proposed increases in space allowance per animal in the vehicle are considerable (roughly a 20-60% reduction of the capacity of vehicles for animals, depending on the species) and will lead to a multiplication of vehicles on the roads, and consequently to significantly more GHG emissions and additional costs. Moreover, the increased space between or over animals will cause problems with keeping a sufficient temperature in the winter, and increases the risk of injuries, especially when vehicles brake or turn. We consider current density rules to be optimal for animals.

Salmonids are often being transported with a bag, filled 1/3 with water and 2/3 with pure oxygen; this method has been effective, especially for smaller fish farms. There is no need for further oxygenation during the transport and this is also not technically feasible for these small salmonid transports. For transportation of carp, tanks without devices like air pumps have also proven to be effective, as the majority of transports take place during the cold season. Furthermore, it should be clarified, that the term “adequate circulation” includes passive movement of water during transportation.

| 8.1. The operator in charge of receiving the aquatic animals shall closely observe them during the post-transport period and keep appropriate records. | deleted |
Under point 7.2 it is specified, that the animals shall be unloaded as soon as possible, in 8.1. the operater shall observe them closely during the post-transport period. This creates a contradiction, as in a lot of production systems (e.g. carp in ponds) it is not possible to observe the transported animals, as it is impossible to differentiate between the transported animals and the animals already in the pond. Furthermore, according to the EU animal health law (AHL Art. 186 1 d) there already has to be record keeping of the mortality rate in aquaculture operations. Considering the goal of reducing bureaucracy and practical feasibility, the paragraph should therefore be deleted.

The registration of a vessel under a flag considered "white", "grey" or "black" under the Paris Memorandum of Understanding does not automatically guarantee the safety or technical condition of the vessel, but rather the color of the country. Therefore, the fundamental criterion for approving the transport of live animals must be the concrete evaluation of the vessel's technical condition and risk profile, rather than the flag under which it operates.
