Draft european parliament legislative resolution
–having regard to Article 294(2) and Article 53(1) and Article 114 of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C100093/2025),
–having regard to the joint deliberations of the Committee on Economic and Monetary Affairs and the Committee on Civil Liberties, Justice and Home Affairs under Rule 59 of the Rules of Procedure,
–having regard to the report of the Committee on Economic and Monetary Affairs and the Committee on Civil Liberties, Justice and Home Affairs (A100000/2025),
2.Calls on the Commission to refer the matter to Parliament again if it replaces, substantially amends or intends to substantially amend its proposal;
3.Instructs its President to forward its position to the Council, the Commission and the national parliaments.

| (7) To ensure consistency and legal certainty, a definition of SMCs should be introduced in those acts. | (8a) The establishment of a distinct category of SMCs aims to improve their access to financing and capital markets, in particular for enterprises that have grown beyond SME status but still face comparable barriers. That new category should not affect the scope or funding of Union measures dedicated to SMEs, nor alter the application of the “think small first” principle, which remains essential to ensuring that micro- and small enterprises continue to benefit from proportionate obligations and targeted support within the Union’s legal framework. |

| (8b) The establishment of a distinct category of SMCs can serve to facilitate better access to capital markets for companies that have grown beyond SME status, without diluting the Union’s commitment to supporting SMEs as the backbone of the European economy. Accordingly, the creation of the SMC category should not affect or reduce the scope of specific provisions tailored to SMEs, nor the budgetary allocations made available to them under the Multiannual Financial Framework. Given that the majority of SMEs are micro-enterprises, the characteristics and resources of which differ substantially from those of small mid-caps, Union law should continue to apply the “think small first” principle in order to ensure proportionality and adequate protection for the smallest companies. |
