Stressesthat, owing to its fragmentation and limited harmonisation, the current European electoral legal framework, as reflected in Council Decision (EU, Euratom) 2018/9942 , is increasingly ill-suited to addressing emerging challenges linked to the use of AI in electoral processes; emphasises, therefore, the importance of preparing the ground for a future reform of the European electoral law in accordance with Article 223 TFEU, which would reflect the impact of AI on the European electoral process, making the European electoral process more resilient in the context of AI misinformation and manipulation;20. Stresses that, owing to its fragmentation and limited harmonisation, the current European electoral legal framework, as reflected in Council Decision (EU, Euratom) 2018/994, remains primarily a framework of coordination and does not confer a mandate for far-reaching harmonisation in the organisation of elections, which remains a core competence of the Member States; considers that emerging challenges linked to the use of AI in electoral processes should first be subject to a thorough, evidence-based mapping, taking full account of national specificities, constitutional identities and democratic traditions; calls for a cautious and Member State-driven reflection on any possible future reforms under Article 223 TFEU, ensuring that any such considerations fully respect national sovereignty and avoid premature or disproportionate regulatory responses, while exploring ways to strengthen resilience against AI-enabled misinformation and manipulation;
