| (9 a) Any programme amendment or transfer of amounts that would be carried out should be without prejudice to the application of measures adopted pursuant to Regulation (EU) 2020/2092 and to the compliance of relevant programmes with horizontal enabling conditions in accordance with Article 15 of Regulation (EU) 2021/1060. Amounts that are suspended under Regulation (EU) 2020/2092 or withheld on the basis of horizontal enabling conditions under Article 15 of Regulation (EU) 2021/1060 should not be subject to a programme amendment or transfer. |

| In Article 24 of Regulation (EU) 2021/1060, the following paragraph is added: | |
| '10a. Commitments suspended by measures adopted in the context of Regulation (EU) 2020/2092 and amounts subject to a negative assessment by the Commission on the basis of the application of enabling conditions pursuant to Article 15 of this Regulation shall not be subject to a programme amendment or transfer pursuant to this Article or to Article 26 of this Regulation.'. |
